Since 25 May 2018, the new EU General Data Protection Regulation (GDPR) has also applied in Austria. It is intended to harmonise data protection law across the EU. In addition, a new Austrian Data Protection Act was adopted, among other measures, and entered into force on 25 May 2018.
The General Data Protection Regulation introduced numerous changes. For example, companies that meet certain requirements must maintain records of processing activities and/or appoint an internal or external data protection officer. Companies are also required to provide an emergency concept for data breaches. The aim is therefore to introduce a data protection compliance programme in the respective companies.
If individual provisions of the General Data Protection Regulation are not complied with, fines of up to EUR 20 million or 4 percent of worldwide group turnover are envisaged.
